Who Needs a Will? Who needs an Appointment of Health Care Agent? The short answer is to each question: EVERYONE.

Every individual over the age of 18 is eligible to draft a Will. Many people assume that if they die without a Will all of their assets would automatically transfer to a surviving spouse, or surviving children. However, in Maryland that is not the case. A valid and enforceable Last Will and Testament is the only way to ensure that your assets, family heirlooms, money, and other personal and real property are transferred exactly as you wish.

Similarly, when catastrophe strikes and one is unconscious, or otherwise unable to handle their own affairs, having an Appointment of Health Care Agent already signed and effective allows you to say who can speak for you when you are unable to make decisions or speak for yourself. Before moving off to college or the next phase of life at age 18, that individual – if they have no other “estate planning document” in place – should have an Appointment of Health Care Agent.
